Divorce or mutual separation
In France. A law authorizing divorce was promulgated in 1792 during the Revolution and repealed in 1816 under the Restoration. It was reestablished in July 1884. A law of the Vichy regime of April 2, 1941 restricts the possibilities of divorce (it cannot take place within three years of marriage). On August 30, 1792, the Legislative Assembly “declares that marriage is dissolvable by divorce” and thus rehabilitates divorce, a legal category of Roman law that canon law had succeeded in concealing. The law of September 20, 1792 established the secularization of civil status and the authorization of divorce. The law provides for three valid grounds for divorce: separation of spouses for a year, adultery and physical or mental cruelty. Warning! It is not necessary to obtain a legal separation before filing for a divorce.
